Terms of Service

We’re excited to help you launch your business with our range of start-up funding and digital services. By using our services, you agree to the following terms and conditions. Please read them carefully to understand the scope and limitations of our offers.

Business Funding

1. Rates starting at 0%: Rates are dependent on several factors and are not guaranteed. StartCap does not determine rates or have any impact on the rate received.

2. Same-day funding: Same-day funding does not apply to all funding offers. Same-day funding is dependent on the client’s ability to provide necessary documentation as well as 3rd party lenders/creditors to accept & process those documents, as well as other functions required in underwriting. To expedite your funding, send all requested documentation at your earliest convenience.

Mobile Text Message Opt-In

By providing your mobile number and opting into our text messaging service, you consent to receive text messages from StartCap.org related to your account, transactions, funding updates, and other relevant information. Message frequency may vary. These messages are transaction in nature, and never sent in bulk. Standard messaging rates may apply based on your mobile service provider’s terms. You can opt-out at any time by texting STOP in response to any of our messages or contacting customer support at Support@StartCap.org.

Free Services

1. Free Domain Name

  • Scope of Work: We provide a free domain name for the first year.
  • TLD Options: Domain name extensions (TLDs) are limited to .com, .net, .org, or any TLD of equal or lesser value.
  • Auto-Renewal: The domain will automatically renew at $49 per year after the first year unless you cancel the renewal.
  • Client Responsibility: The client is responsible for managing the domain after the first year, including renewal and any associated costs.
  • Limitation of Liability: We are not responsible for any domain-related issues, including but not limited to expiration, transfer, or third-party disputes.
  • Renewal Notification: Notifications regarding auto-renewals will be provided within a reasonable amount of time before the renewal date to ensure clients have ample opportunity to take necessary actions. If we cannot reach you, you decide not to renew, and/or your credit/debit card declines, the domain will expire and you will be responsible for reacquisition of the domain. StartCap takes no responsibility for domain availability or fees to purchase the domain after expiration.

2. Free Custom Website

  • Scope of Work: The custom website includes up to 4 pages based on pre-existing templates. Custom coding or development outside of the provided design work is not included.
  • Content Provision: The client must provide all text, images, and media for the website by the specified deadline to avoid project delays.
  • Revisions: Includes two rounds of design revisions. Additional revisions may incur extra charges.
  • Maintenance and Updates: The free service covers the initial setup of the website. Ongoing maintenance and updates are not included but can be purchased separately.
  • Limitation of Liability: We do not guarantee specific outcomes from the website design and limit our liability to the amount paid by the client.

3. Free Logo Design

  • Scope of Work: Our team will design a logo with revisions at our discretion.
  • Revisions: Limited to a reasonable number of revisions at our discretion. Major redesigns are not included.
  • Usage Rights: The client is granted a non-exclusive license to use the logo. Design credit (e.g., “Logo designed by [Your Company]”) must be included where applicable.
  • Limitation of Liability: We are not responsible for any trademark or copyright issues arising from the use of the logo.

4. Free Google Ads Management

  • Scope of Work: Management is limited to $500 of ad spend managed per month. This includes the setup and optimization of the campaign.
  • Client Responsibility: The client is responsible for 100% of the ad spend. StartCap does not cover payment for Google Ads; the client is solely responsible for all ad spend costs. StartCap acts as a management company and does not provide ad serving directly.
  • Performance Disclaimer: We do not guarantee specific results from the ad campaigns.
  • Limitation of Liability: Our liability is limited to the management fees, excluding the ad spend.

5. Free Social Media Management

  • Scope of Work: Management is limited to $500 of ad spend managed per month. This includes the setup and optimization of the campaign.
  • Client Responsibility: The client is responsible for 100% of the ad spend. StartCap does not cover payment for social media ads; the client is solely responsible for all ad spend costs. StartCap acts as a management company and does not provide ad serving directly.
  • Performance Disclaimer: We do not guarantee specific results from the social media campaigns.
  • Limitation of Liability: Our liability is limited to the management fees, excluding the ad spend.

6. Free Google My Business (GMB) Setup & Optimization

  • Scope of Work: This service is limited to a single location.
  • Initial Setup: Includes setup and optimization of the GMB profile.
  • Updates: Ongoing updates and management are not included.
  • Limitation of Liability: We do not guarantee specific results from the GMB setup and optimization.

7. Free Professional SEO

  • Scope of Work: Applicable to a single website. Includes technical SEO configuration, site speed optimization, and one new post bi-weekly created by our team. Link building is not included.
  • Content Creation: Our team will create necessary content for SEO purposes.
  • Performance Disclaimer: SEO results may vary, and we do not guarantee specific rankings or traffic improvements.
  • Limitation of Liability: Our liability is limited to the SEO service fees.

8. Free Web Hosting

  • Scope of Work: Web hosting is free for three months.
  • Auto-Renewal: Hosting will renew at our standard rates after the free period unless canceled.
  • Client Responsibility: The client is responsible for managing the hosting service after the free period.
  • Limitation of Liability: We are not responsible for any downtime, data loss, or other issues related to the hosting service.
  • Renewal Notification: Notifications regarding auto-renewals will be provided within a reasonable amount of time before the renewal date to ensure clients have ample opportunity to take necessary actions.

9. Free Directory Listings

  • Scope of Work: Limited to one location. Includes initial setup of directory listings (100+).
  • Updates: Edits and updates after the initial setup are not included.
  • Performance Disclaimer: We do not guarantee specific results from the directory listings.
  • Limitation of Liability: Our liability is limited to the setup fees.

General Terms

Duration and Limitations

  • Services such as SEO, GMB optimization, social media management, Google Ads management, and web hosting are free for three months beginning the date of initial funding approval.
  • Free domain is valid for one year, with an auto-renewal fee of $49/year thereafter.
  • Custom website creation is limited to 4 pages with a reasonable expectation of time investment for creation and edits.
  • Free Google Ads and social media management are each limited to $500 of ad spend managed per month, including setup and optimization.
  • GMB setup is for one location only.
  • SEO services include content creation/modification or optimization limited to one new post every two weeks and technical SEO configuration and site speed optimization. No link-building is included.
  • Directory listings are limited to one location, with no edits after the initial setup.

Auto-Renewal and Billing

  • The free domain will automatically renew at $49 per year after the first year unless you cancel.
  • Hosting and other services will renew at our standard rates after the free period unless canceled. Notifications regarding auto-renewals will be provided within a reasonable amount of time before the renewal date to ensure clients have ample opportunity to take necessary actions.
  • You will be billed for any services exceeding the specified limits, such as additional ad spend.

User Responsibilities

  • Ensure accurate and up-to-date information is provided for all services.
  • Comply with all applicable laws and regulations when using our services.
  • You are responsible for any costs associated with exceeding the service limits.

Termination of Agreement

  • We reserve the right to terminate this agreement at any time at our discretion. Notifications of termination will be provided in a reasonable timeframe to allow for transition.

Funding Approval & Payment Requirement

  • All free services are contingent upon the client being approved for and accepting funding. Client must provide proof of approval & acceptance above $100,000 to qualify for any free services and success fee payments must be paid in full before initialization of free services.

Limitation of Liability

  • We do not guarantee specific outcomes or results from our services.
  • We are not responsible for any issues or losses arising from circumstances beyond our control, including technical failures, changes in market conditions, or third-party actions.
  • Our liability for any claim arising out of or in connection with these terms is limited to the amount paid by you for the services in the month preceding the claim.

Dispute Resolution

  • Any disputes arising out of or relating to these terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Changes to Terms

  • We reserve the right to modify these terms at any time. Changes will be posted on our website, and continued use of our services signifies acceptance of the revised terms.
